What "pre-order" means right now

Sundae Situation hasn't launched yet. Submitting your email through our "Reserve My Pint" form is an expression of interest, not a purchase. No payment is collected at this stage, and submitting the form doesn't create a binding contract of sale or guarantee that you'll receive product.

We use this list to gauge demand and to notify you first when Sundae Situation is ready to ship. When the product is ready, we'll email you with details on how to actually place and pay for an order — those future transactions will be governed by separate terms provided at checkout.

No obligation to purchase or deliver

Joining the pre-order list doesn't obligate you to buy anything, and it doesn't obligate us to sell you a specific quantity, flavor, or delivery date. Founding-batch quantities, flavor availability, and launch timing are estimates and may change based on production capacity, ingredient availability, or demand.

Product information and nutritional claims

Product descriptions, flavor names, and nutritional figures shown on this site (including protein, calorie, and sugar figures) reflect our target formulation and are subject to change based on final recipe testing and lab verification. Confirmed nutritional information will accompany the product at the time of sale and appear on physical packaging.

Product images may include stylized or illustrated elements. We aim to represent the product accurately, but slight variation between images and the final product is possible.

Age and eligibility

This site and our pre-order list are intended for South African residents aged 18 and older. By submitting the form, you confirm you meet this requirement.

Allergens and dietary information

Sundae Situation products contain dairy and may contain or be produced in a facility that handles other common allergens — including but not limited to nuts, gluten, and soy, depending on flavor. Full allergen information will be provided on product packaging and at checkout once the product is available for purchase. If you have a food allergy or intolerance, please wait for full ingredient disclosure before ordering.

Intellectual property

The Sundae Situation name, logo, mascot character, "Formula26" name and process description, and all site content (text, images, and design) are the property of Sundae Situation and may not be copied, reproduced, or used without our written permission.

Limitation of liability

This site and the information on it are provided "as is." While we take care to keep information accurate, we make no guarantees about launch timing, product availability, or that the site will be error-free or uninterrupted. To the fullest extent permitted by South African law, Sundae Situation is not liable for any indirect or consequential loss arising from your use of this site or reliance on pre-launch information.

Changes to these terms

We may update these terms as the business develops — particularly once real transactions and shipping begin. We'll update the "Last updated" date above whenever changes are made. Continued use of this site after changes are posted means you accept the updated terms.

Governing law

These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 and the Protection of Personal Information Act 4 of 2013, where applicable.
